At the completion of the promotional period, servicing will continue at the standard service rate applicable at that time unless cancelled in accordance with the service agreement.

If a valid payment method is not maintained, the promotional discount is forfeited and standard servicing charges may apply.

2. 0% Finance

You can advertise“0% finance”, but only if the headline claim is literally true, the finance is actually available, and all material qualifications are disclosed clearly and prominently, not buried in fine print. ASIC’s current RG 234 applies to advertising of credit products and credit services, and is directed at avoiding false or misleading statements or misleading or deceptive conduct.

If there are any fees, “0% finance” may be misleading unless the ad makes clear that 0% refers only to the interest rate, not to the total cost of credit. The Harvey Norman/Latitude litigation is the obvious warning: ASIC succeeded where “interest free/no deposit” advertising failed to adequately disclose that consumers needed a credit card and were liable for monthly account service fees and establishment fees. See amendments above.

The disclaimer should include all of the following:

What products are eligible — all equipment or selected models only.

Maximum financed amount — “up to $15,000” should not imply everyone gets $15,000.

Minimum spend, if any.

Finance term — e.g. 12, 24, 36 months.

Repayment structure — equal monthly repayments, balloon/residual, deferred repayments, etc.

All fees and charges — establishment, account-keeping, monthly service, PPSR, documentation, late payment, early termination, residual/balloon, merchant/processing fees.

Whether a separate credit facility/card is required.

Whether the cash price is the same as the financed price — if the equipment price is inflated to fund the “0%” offer, the “0%” claim may be risky.

Offer period and availability.

Credit provider identity and licence/credit representative details, where relevant.
